Justices dismiss appeal

The Indiana Supreme Court has dismissed an appeal in an insurance case involving attorney-client privilege because the parties have reached a mediated settlement.

The justices granted transfer March 10, 2011, to Allstate Insurance Co. v. Timothy Clancy, et al., No. 45S03-1103-CV-138, in which a divided Indiana Court of Appeals reversed an order granting a motion to compel the production of documents from Allstate. At issue was whether the attorney-client privilege had been waived.

The interlocutory appeal is now dismissed and the Court of Appeals’ opinion on the case remains vacated and is not precedent, according to the high court’s order.
