Bills on magistrates; custody and visitation pass House

The Indiana House of Representatives passed House Bill 1041 Thursday morning 96-0. The bill addresses petitions to modify custody and visitation involving children who have been abused or neglected.  

The legislation says that if a person files a petition to establish or modify a guardianship, visitation or child custody, a party to the proceeding shall inform the court if a party has been determined to be a perpetrator in a substantiated assessment of child abuse or neglect; or the child named in the petition has been the subject of a substantiated report of abuse or neglect, determined to be a child in need of services or has been involved in an informal adjustment.

The introduced version of the legislation was prepared by the Department of Child Services Interim Study Committee.

House Bill 1061, allowing Marion Superior Court and Warrick Circuit and Superior courts to appoint magistrates, passed 94-0.

If approved by the Legislature, both laws would be effective July 1.
