Justices decline to order mediation in walkout fines case

The Indiana Supreme Court issued an order Monday refusing to order mediation in the lawsuit filed by Democratic lawmakers after some of their pay was withheld following legislative walkouts in 2011 and 2012.

The Supreme Court heard arguments Jan. 3 in Tim Berry, et al. v. William Crawford, et al., 49S00-1201-PL-53. At issue is whether the Legislature had the power to withhold from Democratic lawmakers’ per diem payments the fines that were assessed when the minority bolted from the House in an effort to prevent votes on right-to-work legislation.

According to the court docket, updated Tuesday, the justices denied the legislators’ motion for appellate alternative dispute resolution that was filed in January. But the decision doesn’t mean the parties can’t decide to mediate on their own “mutually agreeable terms,” the order says.
