9 a.m. 45S03-1308-CT-531. After a spectator injured by a foul ball during a professional baseball game sued the ballpark operator for premises liability and negligence, the Lake Superior Court denied the operator’s motion for summary judgment. The Court of Appeals reversed and held that the operator is entitled to summary judgment. South Shore Baseball, LLC v. DeJesus, 982 N.E.2d 1076 (Ind. Ct. App. 2013), vacated. The Supreme Court has granted a petition to transfer the case and has assumed jurisdiction over the appeal.
