Indiana State Ethics Comm’n v. Patricia Sanchez - 5/22/14

9 a.m.  49S02-1402-PL-80. Sanchez, a former state employee, petitioned for judicial review of an adverse determination by the Ethics Commission finding Sanchez violated a prohibition on personal use of state property and barring Sanchez from future state employment.  The trial court granted Sanchez’s petition and vacated the Commission’s determination.  The Court of Appeals affirmed, holding among other things that a prior probable cause determination made by a criminal court had preclusive effect in the subsequent ethics proceedings against Sanchez.  Indiana State Ethics Comm’n v. Sanchez, 997 N.E.2d 16 (Ind. Ct. App. 2013), vacated.  The Supreme Court has granted a petition to transfer the case and has assumed jurisdiction over the appeal.
