Justices dismiss DCS transfer petition

The Indiana Supreme Court has dismissed a transfer petition filed by the Indiana Department of Child Services because the Indiana Court of Appeals ruled in favor of the DCS.

DCS filed a petition to transfer under Appellate Rule 57 to ask the high court to address whether a trial court hearing a parental rights termination case is required to make findings that are fully supported by the evidence and that provide an explanation as to how its findings of fact support its order, as ordered by the Court of Appeals.

Appellate Rule 57 allows someone to petition to transfer to the Supreme Court from adverse COA decisions, but DCS never claimed the appellate ruling was adverse and even acknowledged the ruling was in its favor. As such, the high court dismissed the DCS transfer petition.
