Justices suspend Bloomington attorney who arranged drug buy

Bloomington attorney David Schalk, who arranged a drug buy in 2007 in an attempt to impeach a witness’s credibility at trial, has been suspended for at least nine months by the Indiana Supreme Court.

Schalk was convicted of Class A misdemeanor attempted possession of marijuana for trying to set up a drug buy with the state witness in his client’s trial for dealing in methamphetamine. Schalk wanted to prove the witness was still dealing drugs.

The Indiana Court of Appeals upheld his conviction in February 2011.

The justices handed down the suspension Monday. Schalk’s suspension begins May 24, and he must petition for reinstatement once his suspension is over. The justices also denied Schalk’s request for oral argument on the matter.

The costs of the proceeding are assessed against him. Schalk, who practices in criminal defense, was admitted to the bar in 1990.
