The Indiana Supreme Court will hold oral arguments in a case alleging negligence against the Putnam County sheriff Tuesday
at Indiana University School of Law - Indianapolis.
Pamela Price sued the Putnam County sheriff for negligently failing to warn motorists of a known hazard on a county highway
after she was involved in an accident caused by icy roads. She claimed the sheriff owed a common law duty of ordinary and
reasonable care to warn drivers of known hazardous conditions such as the icy road.
The Indiana Court of Appeals affirmed on interlocutory appeal the trial court order denying the sheriff’s motion to
dismiss the civil action, ruling that caselaw supports the notion he had a duty to warn the public and that the sheriff isn’t
immune to liability.
