The subcommittee formed to address the issue of illegal police entry following an Indiana Supreme Court ruling will hear public testimony and discuss draft language at its Wednesday meeting.

The Legislative Council Subcommittee on Barnes v. State was formed in response to the controversial May decision in which a split high court held the common-law right to resist unlawful police entry into a home is against public policy and incompatible with modern Fourth Amendment jurisprudence.

The Indiana attorney general and seventy-one legislators are encouraging the Supreme Court to take another look at the case. The petition for rehearing was filed by Richard Barnes’ attorney Erin Berger in June.

At Wednesday’s 1 p.m. meeting, the subcommittee will hear public testimony on the ruling. Those who want to testify should arrive early to Room 431 in the Statehouse, where a signup sheet will be made available. The lawmakers will also discuss draft language and set its next meeting date.
