Court affirms 3-year home detention for Class D felony

A man was properly sentenced to three years of home detention for conviction of Class D felony receiving stolen property, the Indiana Court of Appeals ruled Friday.

Jerome Perry challenged his conviction on the basis that the maximum sentence of home detention should have been six months. “Perry’s argument is based on the premise that he was sentenced to home detention as a condition of probation,” Judge Terry Crone wrote for the panel. “He was not. Instead, the trial court ordered home detention as a direct placement in community corrections pursuant to Indiana Code Section 35-38-2.6-3.”

In affirming Jerome Perry v. State of Indiana, 39A05-1407-CR-346, the COA noted that Perry did not challenge his sentence as inappropriate in light of the nature of the offense and his character.
