The following 7th Circuit Court of Appeals opinion was posted after IL deadline Thursday:
United States of America v. Jackie H. Richardson
U.S. District Court, Southern District of Indiana, Indianapolis Division, Judge Tanya Walton Pratt.
Criminal. Affirms denial of motion to dismiss the federal prosecution against Richardson. Holds that Richardson’s speedy trial right under the Sixth Amendment was not violated. Judge Hamilton concurs in separate opinion.
7th Circuit Court of Appeals
United States of America v. Booker T. Sewell
U.S. District Court, Northern District of Indiana, Fort Wayne Division, Judge Theresa L. Springmann.
Criminal. Affirms convictions of being a felon in possession of a firearm and maintaining a place for the purpose of distributing controlled substances, but vacates Sewell’s conditions of supervised release and remand for resentencing because the conditions of supervised release requires that they are to fit the peculiar circumstances of the defendant. The magistrate judge rightly issued the warrant to search the home where Sewell was believed to live, and there was no mistake in imposing either the firearm or drug-quantity enhancement.
