Tax Court affirms Zionsville office assessment

The Indiana Tax Court on Thursday affirmed the real estate assessment of an office building on Zionsville’s Main Street in Boone County.

Property owners Lee and Sally Peters appealed the assessment of their property, a 2,852-square-foot office building. The assessment, which rose from $306,000 for the 2009 tax year to $420,000 for 2010, had been upheld by the Indiana Board of Tax Review.

Senior Judge Thomas Fisher wrote that the Board of Tax Review erred in concluding that the Peterses bore the burden of proof that the assessment increase was improper, but evidence presented to the board didn’t establish that the property had been overvalued.

“Given these evidentiary presentations, the Court cannot say the Indiana Board erred,” Fisher wrote. “The Assessor’s explanation as to why and how she increased the assessment was, at first blush, sufficient to demonstrate that the increase in the assessment was proper.”

The case is Lee and Sally Peters v. Lisa Garoffolo, Boone County Assessor, and the Indiana Board of Tax Review, 49T10-1207-TA-42.
