Indy attorney suspended after second OWI conviction

An Indianapolis attorney convicted of operating while intoxicated has been suspended from the practice of law in Indiana for six months without automatic reinstatement.

In January 2017, attorney Jordan E. Olivetti pleaded guilty to Class A misdemeanor operating a vehicle while intoxicated in exchange for the dismissal of resisting law enforcement, possession of marijuana and possession of paraphernalia charges. Olivetti was previously convicted of misdemeanor OWI in 2003 and of minor consumption of alcohol, also a misdemeanor, in 2000.

The Indiana Supreme Court Disciplinary Commission filed a complaint against Olivetti, of Olivetti Law, after his 2017 conviction, and in a Friday opinion that Indiana Supreme Court found he had violated Indiana Professional Conduct Rule 8.4(b). That rule relates to attorney conduct that reflects adversely on his trustworthiness and fitness.

In addition to Olivetti’s six-month suspension, the attorney was already under a suspension order for nonpayment of dues. Olivetti can petition for reinstatement at the end of the six-month period, provided he has cured the cause of all suspensions against him.

The costs of the proceedings are assessed against Olivetti. All justices concurred in In the Matter of: Jordan E. Olivetti, 49S00-1710-DI-656.
