Appellate court to hear arguments in Lafayette

A panel of Indiana Court of Appeals will visit Ivy Tech Community College in Lafayette Thursday to hear the appeal of a man challenging his sentence for dealing cocaine.

In Paul Patterson v. State of Indiana, No. 09A02-0909-CR-849, Paul Patterson pleaded guilty in 1998 to Class B felony dealing in cocaine, but he didn't appear for his sentencing hearing. When he was returned to court in 2009, his plea agreement was accepted and he was sentenced to 10 years in prison, the maximum allowed under the agreement.

Patterson appeals his sentence, claiming the trial judge should have recused himself because he was the deputy prosecutor when Patterson was charged. He also argues that he received ineffective assistance of counsel at his sentencing hearing.

Judges Patricia Riley, Melissa May, and Margret Robb will hear the case at 10 a.m. in the Ivy Hall of the college.
