Federal civil, bankruptcy fees to increase May 1

The fee for filing a civil case in federal court will increase from $350 to $400 May 1. The new $50 general administrative fee for filing a civil action, lawsuit or proceeding in a District Court was approved by the Judicial Conference of the United States in September 2012.

The administrative fee doesn’t apply to persons granted in forma pauperis status or to the filing fee for a writ of habeas corpus. That fee will remain $5.

Also on May 1, Bankruptcy courts will begin charging a new fee of $25 for each claim transferred. This fee was also approved at the September 2012 judicial conference session.

The fee will be assessed by Bankruptcy courts upon the filing of the claim transfer, whether filed by a transferee or transferor, and it also applies to partial claims transfers. The fee must be paid by credit card upon the filing of the claims transfer.
