AG asks court to appoint attorney as receiver of INCASA

Indiana Attorney General Greg Zoeller has asked a Marion County Court to appoint an attorney as receiver of an Indianapolis-based nonprofit that suspended operations in June due to financial insolvency.

The Indiana Coalition Against Sexual Assault Inc. laid off its entire staff earlier this year due to a “substantial amount” of unpaid taxes dating back to 2012, according to an announcement on its website.

INCASA’s board of directors reached an agreement with the state that freezes the organization’s assets and allows the current board members to step aside so a court-appointed receiver can reorganize the nonprofit, Zoeller announced Friday. The board will resign upon the receiver’s appointment. The organization has not been dissolved, but it is in danger of insolvency.

He has asked the court to appoint Deborah J. Daniels as receiver. She is a former U.S. attorney in the Southern District of Indiana and a former assistant attorney general for the Office of Justice Programs in the U.S. Department of Justice, where she managed the research and grant-making office of the department.

“We recommend Deborah Daniels because this situation calls for a court-appointed receiver with stellar management experience and credibility to correct and repair the organization’s finances and ensure that the important work INCASA performed is resumed; and we urge the Court to grant this motion swiftly,” Zoeller said.

State law gives the attorney general’s office the authority to intervene on behalf of the public interest in charitable organizations and ask a court to appoint a receiver. INCASA, founded in 1987 as a training and advocacy organization in Indianapolis, distributed grant funds received from the federal government to local providers of services for sexual assault victims. It also developed statewide educational and prevention programs and advocated for legislation on behalf of sexual assault victims.
