Some Indiana residents who have subscribed to Sirius XM Radio Inc. may be entitled to a refund following the satellite radio company’s multi-state settlement regarding claims of misleading advertising and billing practices.

Forty-four states and the District of Columbia alleged Sirius XM engaged in misleading, unfair and deceptive acts or practices in violation of state consumer protection laws. Indiana Attorney General Greg Zoeller reported 67 consumers in Indiana have filed complaints against the company with the attorney general’s office.

Customer complaints included difficulty in cancelling contracts, contracts that were automatically renewed without customer consent and unauthorized fees. As a result of the settlement, the radio company will pay $3.8 million and make changes to its business practices.

The refund amounts will vary on a case-by-case basis. Indiana will receive $77,240.85 to be deposited in the Consumer Protection Fund for use in future consumer protection enforcement, education, litigation or restitution.

Complaints must be received by the Indiana attorney general’s office by May 1, 2015, to be considered for restitution, and may be filed at www.IndianaConsumer.com. Complaints can also be filed directly with Sirius XM at www.siriusxm.com/settlementprogram.
