Supreme Court seeks feedback on proposed rules amendments

The Indiana Supreme Court is seeking feedback on proposed changes to judicial rules from Hoosier legal professionals and members of the public.

The Court’s Committee on Rules of Practice and Procedure is considering amendments to five Indiana practice rules: Professional Conduct Rule 1.1, Code of Judicial Conduct 2.5, Trial Rule 4.1, Trial Rule 9.2 and Affidavit of Debt, and Small Claims Rule 2 and Affidavit of Debt. People interested in providing feedback on the proposed amendments may do so until May 15.

The amendments proposed for Professional Conduct Rule 1.1 and Code of Judicial Conduct 2.5 would add provisions to a requirement for attorneys and judges to keep abreast of legal technology changes. Changes to Trial Rule 9.2 and Small Claims Rule 2 deal with debt collection and would require a plaintiff who is not the original creditor to provide additional information when seeking to collect on a debt. The proposed amendment to Trial Rule 4.1 would require a clerk to mail both a summons and a complaint to a last known address when service is made by leaving the summons and complaint at a dwelling or serving an agent.
