Course Description

This course will provide a detailed description of the legal and technical aspects of using the evidence from event data recorders when litigating a crash involving passenger vehicles and/or heavy commercial trucks. Participants will be prepared to apply their legal and technical knowledge of EDRs to their cases.

Topics to be covered include: Purpose of EDRs; EDRs in passenger vehicles and heavy trucks; NHTSA 563 requirements; Data retrieval process and laws governing access; data use and interpretation; application of data to the incident ; ownership of the data / data privacy; admissibility of data; legal implications; spoliation / chain of custody issues; case examples
