Appellate court to visit northern Indiana

A panel of Indiana Court of Appeals judges heads to Michigan City Monday to hear arguments about whether a trial court erred in finding an usher wasn't an employee of Metro Security Forces Inc.

In Steven Barnard v. Metro Security Forces, Inc., et al., No. 71A03-0903-CV-86, Steven Barnard sued the security company after an unknown person with an "usher" tag on pushed him at an REO Speedwagon concert in South Bend. Barnard was injured and also claims the same usher slapped his wife in the face as they were leaving.

Barnard believed the usher worked for Metro Security; the company denied the man worked for them. The trial court granted summary judgment in favor of Metro Security.

Judges Cale Bradford, Paul Mathias, and Margret Robb will have to decide whether the company designated sufficient evidence to make a prima facie showing it didn't employ the usher.

Arguments begin at 12:30 p.m. CST in the Michigan City High School auditorium, 8466 Pahs Road.
