The Indiana Recount Commission voted 3-0 in favor of White, finding the Indiana Democratic Party didn’t provide sufficient evidence that White wasn’t eligible to take office.
The Indiana Recount Commission investigated whether White was eligible to run for office following claims he wasn’t legally registered to vote when he listed his ex-wife’s address as his address on a voter registration form.
Both White and the commission had appealed Marion Circuit Judge Lou Rosenberg’s decision that ordered the commission to hear a challenge from Democrats regarding White’s eligibility. The Indiana Supreme Court granted emergency transfer but declined White’s request to stay the matter. The justices denied rehearing the matter June 16.
Although he remains secretary of state based on the commission members’ decision Tuesday, White could still be removed from office if he is convicted of any of the seven felony counts he faces in Hamilton County, including voter fraud and fraud on a financial institution. His trial on those charges is set for Aug. 8 before Judge Steven Nation.
