The order, dated March 6 and posted Monday afternoon, in Gregory T. Hill v. State of Indiana, No. 71S05-0903-CR-105, concluded that Gregory Hill is an eligible defendant and made the required showings under Post-Conviction Rule 2, Section 2 and should be allowed to file a belated motion to correct error.
He pleaded guilty to two counts of attempted murder and sentenced to two consecutive 22-year terms. He wasn't advised he could challenge his sentence on appeal. The Court of Appeals affirmed the denial of permission to file the belated motion, finding there was no abuse by the trial court.
