Court names special judge for Marion County case

May 10, 2010

A Shelby Superior judge will preside over a forgery investigation case involving Marion County GOP Chairman Tom John, after the presiding judge in the state’s largest county recused himself from the matter.

The Indiana Supreme Court on Friday appointed Shelby Superior Judge Jack A. Tandy as special judge in the case, which has the cause number of 49G02-1005-MC-677. Marion Superior Judge Robert Altice recused himself May 3 from the case, which involves an accusation by John’s ex-wife that he forged her name on a loan document. A three-month investigation by the Indianapolis Metropolitan Police Department led to the matter being forwarded to Marion County Prosecutor Carl Brizzi, who asked for a special prosecutor because he is a Republican with ties to John.

Now Judge Tandy will decide whether a special prosecutor will be named in the case to consider whether any criminal charges are warranted.
