Justices suspend Muncie City Court judge

The Indiana Supreme Court issued an order Thursday suspending Dianna L. Bennington, the Muncie City Court judge who faces 13 counts of misconduct.

On Dec. 15, the Indiana Commission on Judicial Qualifications filed a petition for interim suspension of Bennington with pay, just four days after it filed the misconduct charges against her. The JCQ alleges Bennington improperly jailed defendants, repeatedly violated statutes and court rules, and engaged in public verbal altercations with her children’s father and others. She also allegedly used a racial slur aimed at an African-American woman that the commission says was videotaped.

Bennington has been on paid voluntary leave of absence since Sept. 29.

The justices’ order took effect at midnight Friday, and Bennington is suspended with pay. The suspension will continue until further order from the Supreme Court.
