Civil. Vacates the dismissal of the claims of Tommy Morris against Nuzzo. The District Court erred in its determination that Nuzzo was fraudulently joined. Remands with instructions the case be further remanded to the Trumbull County Common Pleas Court of Ohio.

Convicted ex-coroner hits Brizzi with legal malpractice suit

Former Hancock County coroner Tamara Vangundy paid for negligent legal advice on her plea deal in a drunken-driving and official-misconduct case that ended her career as an elected official, she alleges in a legal malpractice claim filed against former Marion County Prosecutor Carl Brizzi.

7th Circuit orders Indiana case sent back to Ohio

A federal judge in the Southern District of Indiana erred when she determined that a claims adjuster from Ohio was fraudulently joined to a case that was transferred out of federal court in Ohio to Indiana, the 7th Circuit Court of Appeals ruled. The case also presented two issues of first impression for the Circuit.

Subcontractor’s suit belongs in Hamilton County

The Indiana Court of Appeals Thursday reversed the denial by an Allen Circuit judge to remove a lawsuit brought in that county to Hamilton County, where two parties to the lawsuit had agreed in a contract any legal claims would be handled.

Court rules in favor of insurer in environmental cleanup dispute

A release executed between a chemical manufacturing business and its insurer that relieved the insurer from claims or demands related to remediation was unambiguous and covered all policies held by the company, not just the primary liability ones, the Indiana Court of Appeals ruled.

Civil tort. Reverses summary judgment in favor of the NCAA on Lanni’s negligence claim. The trial court abused its discretion when it denied Lanni’s April 20, 2012, motion for alteration of time. It effectively deprived her of a reasonable opportunity to present any material made pertinent to a Trial Rule 56 motion. Affirms denial of Lanni’s motion to strike the affidavit by the NCAA’s fencing championship manager, designated by the NCAA, that the NCAA was not involved in the fencing match where Lanni was injured.

COA reverses summary judgment for NCAA on negligence claim

A woman who was injured at a fencing event at the University of Notre Dame should have been granted more time to present relevant materials in opposition to the National Collegiate Athletic Association’s motion for summary judgment on her negligence claim, the Indiana Court of Appeals ruled Wednesday.

Defendant not at fault for failing to timely appeal

The Indiana Court of Appeals declined to hold a man at fault for the failure to file a timely notice of appeal, pointing to his attorney’s death from cancer shortly after the sentencing hearing.

Small claim. Affirms granting of judgment in favor of Dorita Lee and Brealon Miller. Concludes the lower court did not err in awarding Lee and Miller zero damages.   

Christine and George Evan v. Trustgard Insurance Company, d/b/a Grange Insurance (NFP)

Civil tort. Dismisses the Evans’ appeal of denial of their motion to compel discovery responses in their action against Trustgard Insurance Co., doing business as Grange Insurance. Finds the Evans are not appealing a final judgment and did not properly perfect a discretionary interlocutory appeal. The COA rules it has no jurisdiction to entertain the appeal of the trial court’s denial.

Criminal. Affirms denial of Napier’s motion to suppress the evidence. Concludes that since the Indiana Gaming Commission officer’s actions in helping Napier’s girlfriend retrieve personal items from Napier’s truck did not constitute a search under the Fourth Amendment, the COA does not reach Napier’s argument that the search was unjustified under the automobile exception to the warrant requirement.

Concludes Stewart waived appellate review of his claim that the trial court erred in permitting the state to belatedly amend the Information to include a habitual offender allegation. Criminal. Affirms Price’s convictions and sentence for Class D felony pointing a firearm and Class A misdemeanor battery resulting in bodily injury. Finds the trial court did not err in excluding Price’s alibi witness and in instructing the jury. Also concludes Price has failed to carry his burden to show that his sentence is inappropriate.   

In the Guardianship of D.M.: W.G. v. B.P. (NFP)

Guardianship. Affirms termination of W.G.’s (grandfather) guardianship over D.M. (granddaughter). Finds the trial court did not abuse its discretion either in terminating grandfather’s guardianship of D.M. or in awarding mother immediate custody of D.M.
