Criminal. Reverses a Blackford Superior Court’s jury’s conviction of Zachary Lester for a Level 6 felony intimidation charge based on a Snapchat message that he sent to a private group. Finds that there was a lack of evidence that Lester communicated the message in a way that indicated an intent to reach the target, if there was one. Also finds that while Lester’s Snapchat message was inappropriate and disturbing, the state did not present sufficient evidence to support a conviction for Level 6 felony intimidation.
