The Indiana Court of Appeals will hear arguments in Valparaiso Monday in a case involving an automobile accident and the statute of limitations to amend a complaint.

The panel of Judges John Sharpnack, Nancy Vaidik, and Michael Barnes will be asked to decide in Tim Sinks v. Krista L. Caughey, 49A04-0709-CV-502, whether the trial court erred in denying Sinks’ motion to dismiss and allowing Caughey to amend her complaint. Caughey was rear-ended by a pickup truck, and she relied on the information provided by the insurance company – which insured both vehicles involved – for the identity of the driver when she filed her initial complaint. Caughey later learned Sinks was actually driving and filed a motion to amend her complaint. Sinks objected and filed a motion to have the amended complaint dismissed because it was filed after the statute of limitations had run out.

The arguments begin at 3 p.m. CT at Valparaiso University School of Law, 656 S. Greenwich St., Valparaiso.
