The Indiana Supreme Court accepted two cases for the week ending Oct. 19, according to a transfer list released Monday.

The justices unanimously granted transfer to City of Indianapolis v. Rachael Buschman, 49A02-1108-CT-782. The Indiana Court of Appeals reversed a trial court entry of summary judgment and damages in favor of Buschman, whose car was struck by an Indianapolis police officer. The appellate court ruled unanimously that Buschman’s tort claim notice was insufficient.

The court also took up Ohio Farmers Insurance Company and S.C. Nestel, Inc. v. Indiana Drywall & Acoustics, Inc., 49A02-1106-CC-534. The Court of Appeals found that judgment in favor of Indiana Drywall was proper, but reversed a motion for summary judgment with respect to Indiana Drywall’s claim to recoup through a bond held by Ohio Farmers. The case involves payment for work on a Walmart store and other retail buildings in Lawrence County.

Justices also last week unanimously denied transfer to 10 cases. The transfer list may be viewed here.
