The Indiana Supreme Court issued an order Monday vacating transfer to a case it accepted in October.

The justices reinstated the Indiana Court of Appeals decision in Ohio Farmers Insurance Co., et al. v. Indiana Drywall & Acoustics Inc., 49A02-1106-CC-534. The case involves payment for work on a Wal-Mart store and other retail buildings in Lawrence County.

The Court of Appeals found that judgment in favor of Indiana Drywall was proper, but it reversed a motion for summary judgment with respect to Indiana Drywall’s claim to recoup through a bond held by Ohio Farmers.
