Gibson County Judge Jeffrey Meade rejected the motion filed for Austin Blaize of Francisco. A jury convicted Blaize in August of murder and other charges in the January 2013 killing of 47-year-old Terry Monier at the older man's home near the town of Fort Branch about 20 miles north of Evansville.
The Princeton Daily Clarion reports defense attorney Ivan Arnaez asked the judge to throw out the murder conviction, maintaining that evidence didn't support that Blaize set out to kill Monier. The jury recommended a sentence of life in prison without parole because of the murder conviction.
Blaize's sentencing hearing is scheduled for Thursday.
