Otter Creek Trading Company Inc. and Daniel Pohle v. PCM Enviro PTY, LTD.
Miscellaneous. Affirms $147,000 default judgment for PCM after COA found the trial court did not abuse its discretion when it ruled Otter Creek’s reply to the complaint was too short after PCM sued for breach of contract because Otter Creek did not send a smelter PCM paid for. Also finds it didn’t matter that PCM did not have a certificate of authority and was not a full business, Otter Creek still needed to fulfill its contractual obligations.

Mario D. Bell v. State of Indiana (mem. dec.)
Criminal. Affirms Mario Bell’s convictions of Level 4 felony possession of a firearm by a serious violent felon and Level 6 felony resisting law enforcement.

Randall L. Grigsby v. State of Indiana (mem. dec.)
Criminal. Affirms Randall Grigsby’s conviction of Level 1 felony rape.

Indiana Tax Court
Kathryn Gillette v. Brown County Assessor
Tax. Affirms real property assessment of $592,000 for property in Brown County  after the court found Kathryn Gillette did not present probative evidence that her property should be assessed any lower. Finds the Indiana Board of Tax Review did not use the wrong method for determining the assessment.
