Fishers fitness firm sanctioned for violating injunction

A Fishers fitness business must pay a $1,000 penalty for violating a court order in a franchise dispute.

Rosalyn R. Harris owned and operated a Get in Shape Inc. franchise in Fishers for about two years until terminating the contract in June 2015. She then began operating a rival business called Fit Chicks in the same location, according to a Wednesday court order.

Harris continued even after a Massachusetts federal court granted an injunction prohibiting her from operating the business in the location or using Get in Shape’s trademarks, logos or confidential information. U.S. Judge Richard Young wrote that a secret shopper visited the Fit Chicks last summer and observed violations.

Young approved Get in Shape Inc.’s motion for sanctions and ordered Harris to pay $1,000 in attorney fees to the franchiser. Young also extended the injunction until Jan. 1, 2018, and rejected Harris’ motion to vacate the preliminary injunction.
