The Indiana Supreme Court Disciplinary Commission brings charges against attorneys who have violated the state’s rules for admission to the bar and Rules of Professional Conduct. The Indiana Commission on Judicial Qualifications brings charges against judges, judicial officers, or judicial candidates for misconduct. Details of attorneys’ and judges’ actions for which they are being disciplined by the Supreme Court will be included unless they are not a matter of public record under the court’s rules.

Resignation Marion County attorney Deborah M. Agard tendered an affidavit of resignation that was accepted by the court in a Nov. 21 order. Agard’s resignation required an acknowledgement that she could not successfully defend herself from a pending disciplinary investigation or proceeding if prosecuted. The Supreme Court Disciplinary Commission alleged she made multiple unauthorized withdrawals from her law firm trust account between 2013 and 2015. Costs of the proceedings are assessed against Agard.

Suspension Hamilton County attorney Richard S. Mossler was suspended for at least six months without automatic reinstatement, per a Dec. 6 order. The court found Mossler had committed attorney misconduct arising from his relationship with a California corporation that referred consumer debt resolution clients. He opened a trust account in California that he failed to certify with the clerk of the Indiana Supreme Court, which later was overdrawn by nonlawyer employees of the California company. His suspension is effective Jan. 17, 2018. See story, Page 14A.•
