The jury deliberated for approximately two hours before convicting Neil Cook, 58, of the charges, according to a news release.
According to court records, in September 2018, officers conducted a search of Cook’s phone during a welfare check on a child in his home.
That child had taken videos and photos of the contents of Cook’s phone, which included images of young girls fully nude and adult pornography.
When police searched his phone, the images of the young girls were not there, but officers were able to match several other photos on Cook’s phone to the images the child captured of Cook’s device.
Cook will be out on bond while awaiting sentencing on June 25.
His convictions hold sentences of between six months to two-and-a-half years in prison and up to a $10,000 fine for each count.
“I am troubled by the fact that Judge Hollems did not take Cook into custody after he was found guilty,” said Delaware County prosecuting attorney Eric Hoffman in a released statement. “The Defendant is no longer presumed to be innocent, he now stands convicted of two counts of Possession of Child Pornography and should be in jail. I am proud of Deputy Prosecutor Adrian Perez, Prosecutor’s Office Investigator LeAnna Smith, and the Albany Police Department for their hard work and dedication in this case.”
