Fort Wayne attorney suspended for 2019 arrest

Coming to an agreement with the Indiana Supreme Court Disciplinary Commission, a northern Indiana attorney with a lengthy disciplinary history has been suspended for at least one year from the practice of law for his 2019 arrest for possession of a legend drug.

The Indiana Supreme Court on Thursday accepted the agreement between the Disciplinary Commission and Cody R. Williams, suspending Williams for one year without automatic reinstatement, effective immediately.

On Oct. 22, 2019, Williams pleaded guilty to Level 6 felony possession of a legend drug, Class A misdemeanor driving while suspended with a prior judgment and an infraction for operating without financial responsibility.

Williams’ sentencing was deferred so he could participate in a veterans court treatment program. After Williams successfully completed that program in April 2021, the trial court sentenced him to one year suspended to probation, entering his possession conviction as a Class A misdemeanor.

The Fort Wayne attorney has been under an order of interim suspension July 19, 2021, for noncooperation in multiple disciplinary cases.

He was also suspended for noncooperation in July 2019. One of those suspensions was lifted in August 2019, but the rest remained in place.

Then in October 2019, Williams was suspended again for noncooperation with the commission. Later that same month, three suspensions against him were lifted, and another was lifted that December. 

Additionally, Williams is also under orders of indefinite suspension for noncooperation and suspension without automatic reinstatement for prior discipline. Those disciplinary actions were handed down in May 2020 and July 2020.

At the conclusion of the current one-year suspension for his arrest, Williams can petition for reinstatement to the practice of law in Indiana provided that he pays the costs of the proceeding, fulfills the duties of a suspended attorney and satisfies the requirements for reinstatement of Admission and Discipline Rule 23(18), the Supreme Court order states. He has been ordered to pay $265.18 to the Supreme Court’s clerk.
