IN Supreme Court releases proposed amendments of 3 rules, interpreter code of conduct, invites comment

The Indiana Supreme Court is accepting public comment for proposed rule changes for deposition delivery, citation formatting for memorandum decisions and public requests for hearing or trial recordings.

Comments will be accepted through Aug. 3 on proposed amendments to Trial Rule 30(F), Appellate Rule 22(A) and Access to Court Records Rule 4(D), as well as to the interpreter code.

According to the court, the proposed amendment to Access to Court Records Rule 4(D) clarifies that the public may request a copy of a recording of a hearing or trial.

The amendment also adds commentary on a court’s obligation to respond to a request for a copy of a recording and comply with Code of Judicial Conduct Rule 2.17 on broadcast of the recording.

The proposed amendment to Appellate Rule 22(A) would add a citation format for memorandum decisions allowed under Appellate Rule 65(D) and modernize the rule.

The proposed amendment to Trial Rule 30(F) would allow court reporters to deliver depositions electronically rather than by sealed hard copy if the parties agree.

If each party agrees, the officer “shall send the electronic certified original transcript endorsed with the title of the action and marked ‘Original Deposition of (here insert name of witness)’ and shall promptly electronically deliver it to the party taking the deposition.”

The court invites public comment on the proposed rule amendments until Aug. 3, 2023, at noon EST.

The proposed amendment to the Interpreter Code of Conduct and Procedure adds a definition of “qualified interpreter,” clarifies court responsibility to use court-certified or qualified interpreters, and clarifies court use of non-certified telephonic interpreter services once all reasonable options for employing a certified or qualified interpreter have been exhausted.

The court also invites public comment on the proposed code amendment until Aug.3, 2023 at noon EST. Comments may be submitted online or mailed to: Office of Judicial Administration,
