Partners Andrew Baldwin and Max Wiley of The Criminal Defense Team, which has offices in Indianapolis, Noblesville, and Franklin, will appear on the episode “A Death in the Stairwell,” which highlights their defense of a New Haven woman who was accused of murdering her husband.
Wiley said the 48 Hours crew had been following the criminal proceedings of defendant Alison Davis when they approached her defense team about the episode.
He told The Indiana Lawyer that, after clearing it with Davis, he and Baldwin ultimately agreed to be featured on the episode both to clear her name and to shine a light on the injustice in her story.
“Post Innocence Project world, a world where we have DNA and we’ve got very top of the line technology going towards solving these cases, I think law enforcement does a very good job 99% of the time, but there’s still a potential for wrongful convictions, and this very nearly was one,” Wiley said. “So we wanted to just kind of show how this can still happen.”
Davis was charged with her husband’s murder in December 2023.
According to court documents, a jury acquitted Davis in May after six hours of deliberations.
Following her acquittal, the defense team is now in an appeals process to reverse the Allen Superior Court’s granting of the state’s motion to seal certain pieces of evidence without first holding a hearing on the matter.
According to the defense team, the trial court’s action is in violation of the Indiana Access to Public Records Act and the Indiana Access to Court Records Rules.
They argue that photos and videos of a former crime scene do not fall within a mandatory exception to either public access law.
On Oct. 3, the Indiana Court of Appeals dismissed the appeal without prejudice and remanded it to the trial court for further proceedings.
