ISBA poll: Members support retention of Mathias, Vaidik, Weissmann

The three Court of Appeals of Indiana judges sitting for retention in next month’s general election have received a vote of confidence from members of the Indiana State Bar Association.

According to the results of the ISBA’s 2022 judicial retention survey, 87% of respondents support the retention of Judge Paul Mathias while 85% of respondents support the retention of judges Nancy Vaidik and Leanna Weissmann.

Indiana appellate judges sit for retention in the first general election that occurs at least two years after their appointment, then every 10 years after that. The ISBA conducts a member poll before each retention vote to “help Indiana voters make an informed decision about their vote to retain a judge.”

This year’s poll, which was distributed electronically between Sept. 5 and Sept. 30, asked members to respond “yes” or “no” to the question of whether Mathias, Vaidik and Weissmann should be retained. There was also an option for respondents to leave anonymous comments, which are provided to the judges but are not kept in official ISBA records.

Of the 8,409 ISBA members polled, 759 cast ballots.

The November election will mark the third retention vote for Mathias and Vaidik, who were both appointed in 2000 and retained in 2002 and 2012. Weissmann was appointed in 2020, making this her first retention vote.

The Indiana Supreme Court Office of Judicial Administration has created a website for Hoosiers to learn more about the three COA judges seeking retention this year.

No members of the Indiana Supreme Court are up for retention in the Nov. 8 election.
