A Jeffersonville mother and daughter have sued Wesbanco Bank over $21,000 in unauthorized withdrawals they say were taken from their joint checking account last March.

Mary H. Lotze and her daughter Lee Ann say the bank never investigated the withdrawals and has refused to refund the money, according to a complaint filed last week with the U.S. District Court for the Southern District of Indiana.

A bank spokesperson told The Indiana Lawyer the company does not discuss pending litigation.

The Lotzes said in their complaint that an unknown individual took the money from their account in a series of five withdrawals ranging from $3,000 to $5,000 each between March 11 and March 24. The plaintiffs didn’t authorize the withdrawals and closed their account after the last one.

They also asked the bank to investigate and refund the missing money via a written request.

Mary Lotze also filed a report with the Jeffersonville Police Department.

The Lotzes said in court documents that the bank was negligent in allowing the unauthorized electronic transfer of funds and failing to investigate.

They are requesting a jury trial and seeking statutory, consequential, punitive, treble, and compensatory damages, attorneys’ fees and costs, and any other relief the court deems proper.

The case is Mary H. Lotze et al v. Wesbanco Bank Inc., 4:26-cv-00222-SEB-KMB
