As a subscriber you can listen to articles at work, in the car, or while you work out. Subscribe NowA Muncie man has been convicted of dealing in narcotic drugs, a Level 2 Felony that could land him up to 30 years in prison, the Delaware County prosecutor announced Wednesday.
A Delaware Circuit Court jury also convicted Terence Walker, 41, of three additional charges: carrying a handgun without a license, a level 5 felony punishable by one to six years in prison and a $10,000 fine; dealing in marijuana, a class A misdemeanor punishable by up to one year in jail and a $5,000 fine; and possession of paraphernalia, a class C misdemeanor punishable by up to 60 days in jail and a $500 fine.
“With this conviction, another violent felon has been taken off the streets,” Delaware County Prosecutor Eric Hoffman said in written remarks. “The Prosecutor’s Office stands firm in our commitment to hold repeat offenders accountable and to close the revolving door to jail.”
According to court documents, in the early morning of Sept. 30, 2020, a Muncie police officer was on patrol in the area of Willard and Burlington when they observed a silver Chrysler 200. After running a routine license plate check, the officer discovered the registration returned to an orange Chevrolet Cobalt.
The officer activated their emergency lights and pulled Walker over, who was the only occupant of the vehicle.
According to an affidavit, the officer could smell marijuana coming from the vehicle, so they conducted a search based on probable cause.
After searching the vehicle, the officer located a locked black box inside a bag in the passenger seat that had a much stronger scent of marijuana coming from it.
Walker stated that he was unaware of what was inside the box or the code to the combination lock. Walker claimed no responsibility for the box.
Walker had a previous criminal history for possession of methamphetamine and possession of a narcotic drug.
After the officer obtained a search warrant several hours later to open the box, they found a 9mm handgun with 10 rounds of ammunition, a plastic bag containing a brown, powder-like substance, a scale with the same brown substance, a vial of Naloxone and numerous small plastic bags.
The officer also found three bags containing a plant-like substance that later tested positive for marijuana and a glass smoking pipe.
Delaware Circuit Court Judge Thomas Cannon has set Walker’s sentencing for Jan. 6.
