Delaware Circuit Court Judge Judi Calhoun sentenced Montana Davis, 26, after Davis was convicted in April of neglect of a dependent resulting in catastrophic injury, a Level 1 felony.
A probable cause affidavit reported that the child’s father brought the child to Ball Memorial Hospital in January 2023 with a possible broken arm.
A radiology read conducted at Riley Children’s Hospital in Indianapolis revealed the child had two broken legs, a broken arm, 15 rib fractures and two skull fractures with bilateral bleeds to the child’s brain. The fractures were reported to be in several stages of healing.
Davis told police she may have broken the child’s arm when she picked up the child.
According to police, Davis had no explanation for how the child could have 20 fractures, including two skull fractures.
“The evidence in this case demonstrated that the 5-month-old victim sustained abusive head trauma (commonly referred to as shaken baby syndrome),” Delaware County Prosecuting Attorney Eric Hoffman said in a news release. “Make no mistake about it, shaking a baby can irreparably harm a child. Approximately 25% of children who have been shaken die from their injuries. Among the survivors, approximately 60% are left with neurologic effects ranging from mild learning disorders to persistent vegetative states.”
