Attorney Danielle Swan was suspended after pleading guilty in June to felony attempted dealing in marijuana intended for sale to a minor. The plea was part of an agreement that dismissed two additional charges for possession of marijuana and contributing to the delinquency of a minor.
In January, Swan ordered about $130 worth of marijuana products online for a friend to pick up from a dispensary in Michigan, according to court documents. Police learned about the order through text messages they saw on the friend’s phone after he was arrested during a traffic stop.
An investigator said in the documents that the messages indicated Swann and the man were having an extramarital affair, and the attorney was debating whether to purchase products for her 16-year-old son. She later told police that the messages indicated she wasn’t sure she wanted to get any because her son would sometimes sneak into her room and take it when she buys it.
Text messages found during a subsequent search of Swan’s phone showed the attorney sending links of Michigan dispensaries to her son.
During a search of a home Swan frequents, officers found Swan in a back bedroom with her friend, the documents state. Police also found suspected methamphetamine, marijuana and several different pills, according to court documents. Swan was not charged in connection with the pills or suspected methamphetamine.
She was sentenced to four years in prison with one year suspended and 75 days served. Her attorney did not immediately respond to a request for comment.
Swan’s interim suspension is in place until further order of the Indiana Supreme Court.
The case is In the Matter of: Danielle J. Swan, 26S-DI-241.
