Domestic relations, with children. Affirms an order restricting Steven Fougerousse’s parenting time with his daughters. Finds the record provides a rational basis for the trial court’s parenting-time determination that the fathe’rs parenting time would endanger his children’s physical health or significantly impair their emotional development due to his abuse of alcohol. Thus, finds no abuse of discretion and that Fougerousee has failed to establish prima facie error.

Criminal. Reverses the Delaware Circuit Court’s denial of Eugene Robinson’s petition for alternative sentencing and order that he serve his previously withheld six-year executed sentence in the Department of Correction, stayed pending appeal. Remands for a new hearing and instructs the trial court to consider Robinson’s request without objection by the State and to make its discretionary decision accordingly.
