Rainbow Realty Group, Inc., et al. v. Katrina Carter and Quentin Lintner

Civil collection. Affirms the Marion Superior Court’s judgment for tenants Katrina Carter and Quentin Lintner against Rainbow Realty Group Inc. on their claim under Indiana’s residential landlord tenant statutes. Reverses the judgment awarding relief to the couple under the Deceptive Consumer Sales Act and remands with instructions to enter judgment for Rainbow.  Affirms the trial court’s resolution of the remaining claims and counterclaims. Remands with instructions to recalculate the couple’s award of reasonable attorney’s fees, including appellate fees they may seek.

Ashley N. Sanders v. State of Indiana (mem. dec.)

Criminal. Affirms Ashley Sanders’ aggregate 24-year sentence, with 21 years executed in the Indiana Department of Correction and three years suspended to probation, for her guilty plea to two counts of Level 4 felony causing death when operating a motor vehicle with an alcohol concentration equivalent to .15 or more, and for her admission to the infraction of driving too fast for conditions. Finds the Gibson Superior Court did not abuse its discretion in identifying or weighing the aggravating and mitigating circumstances. Also finds Sanders’ sentence is not inappropriate in light of the nature of her offenses and her character.
