Delaware County Prosecutor Jeffrey Arnold told The Star Press that "it's probably not a good idea" for one of his staff members to make a decision in the allegations against City Court Judge Dianna Bennington.
Muncie resident Angela Smith recently filed a police report accusing Bennington of intimidation. Smith is the longtime girlfriend of Delaware County Chief Deputy Sheriff Jason Walker, who's the father of Bennington's 16-month-old twins.
Smith says Bennington angrily confronted her outside Walker's home on Sept. 21.
Bennington responded to those allegations by accusing Smith and another woman of conspiring to follow and harass her.
