The Indiana Supreme Court Disciplinary Commission brings charges against attorneys who have violated the state’s rules for admission to the bar and Rules of Professional Conduct. The Indiana Commission on Judicial Qualifications brings charges against judges, judicial officers, or judicial candidates for misconduct. Details of attorneys’ and judges’ actions for which they are being disciplined by the Supreme Court will be included unless they are not a matter of public record under the court’s rules.
SUSPENSION
Divina K. Westerfield, of Marion County, was suspended for 18 months, without automatic reinstatement in a Dec. 6 order. The justices found she had committed attorney misconduct by improperly soliciting employment and failing to refund unearned funds, in addition to engaging in the unauthorized practice of law in Florida. Justice David dissented, believing a more severe discipline is warranted.
REVISED SUSPENSION
The Indiana Supreme Court revised Marion County attorney Felix O’Neill Rippy’s suspension from indefinite to 18 months, all stayed subject to completion of 18 months of probation pursuant to the terms of his probation in Texas. The justices originally imposed reciprocal suspension on Oct. 7 and revised the suspension in a Nov. 22 order.
