Increased public access to court records will begin August 1, the Indiana Supreme Court said in an order Friday, after hearing recommendations from an advisory task force on remote access to and privacy of electronic court records.

Effective Aug. 1, nonconfidential documents will be publicly available through the Indiana courts website, mycase.in.gov, free of charge in the following case types:

• Miscellaneous criminal (MC);

• Tax sale (TS) and petition for tax deed (TP);

• Civil collection (CC), civil tort (CT), mortgage foreclosure (MF) and civil plenary (CP), and;

• Estate supervised (ES) and trust (TR).

Created by the Indiana Supreme Court in February 2016, the Advisory Task Force on Remote Access to and Privacy of Electronic Court Records was formed to find a balance between governmental transparency with personal privacy in an online environment.

The 19-member task force met three times over the course of 2017 to review presentations and conduct discussion, considering the purposes articulated under Indiana Administrative Rule 9(A)(2), including promoting accessibility to court records, minimizing risk of injury to individuals, promoting government accountability, and protecting proprietary business information.

Chaired by Chief Justice Loretta Rush, the task force was created following the decision for Indiana Courts to make the switch to e-filing by the end of 2018.

The court directed the Office of Judicial Administration to assign staff to implement the order and provide appropriate messaging and instruction to the members of the public and Indiana’s bench and bar.
