Supreme Court creates new ‘access to court records’ rules

The Indiana Supreme has created the Indiana Rules on Access to Court Records to replace several portions of Administrative Rule 9.

In orders handed down Friday, members of the Indiana Supreme Court amended Administrative Rule 9 and its references by striking them from the Indiana Rules of Court. In its place, the high court has created the Indiana Rules on Access to Court Records to specifically replace Administrative Rule 9 (A), (B), (D), (G), and (J).

Administrative Rule 9 (A) has been repealed and replaced with Access to Court Records Rule 1. Likewise, Rule 9 (B) is replaced with Access to Court Records Rule 2; Rule 9 (D) is replaced with Access to Court Records Rule 4; Rule 9 (G) is replaced with Access to Court Records Rule 5; and Rule 9 (J) is replaced with Access to Court Records Rule 12.

Two new rules, Access to Court Records Rule 10 and 11, have also been incorporated into the amendments. Rule 10 deals with a list of records and documents excluded from public access under the rule, to be created and maintained by the Office of Court Services. Rule 11 includes sanctions for failure to comply with the provision of the Access to Court Records rules.

The Indiana Rules on Access to Court Records will take effect Jan. 1.
