The Allen Superior Court Judicial Nominating Commission has announced the names of three finalists vying for an upcoming judicial vacancy that will be created by the retirement of Allen County’s first female judge.

Finalists selected for the judicial vacancy are Fort Wayne attorneys David Bailey and Andrew Williams as well as Allen County Magistrate Brian Cook. Gov. Eric Holcomb will consider each of the three nominees before making a selection for the next Superior Court judge.

vacancy on the Allen Superior Court will occur this month when Judge Nancy Eshcoff Boyer retires effective June 15. The judge officially communicated her intent to retire to Indiana Chief Justice Loretta Rush in January, concluding a career in law spanning nearly 45 years.

Seven applicants submitted their names for consideration for the post. Observing social distancing required to slow the spread of COVID-19, the commission publicly interviewed the candidates on Tuesday and then met in executive session to deliberate and select three finalists.

The commission, chaired by Indiana Supreme Court Justice Steven David, consists of six other members. Under state law, the commission must submit to the governor a list of three candidates with written evaluations of each candidate.

Holcomb now has 60 days to make an appointment to the Allen Superior Court upon officially receiving the list of nominees.
