Unpaid dues, failure to meet CLE requirements leaves 246 lawyers facing suspension

A total of 246 lawyers face suspension from practicing law in Indiana for unpaid dues, violations of Interest on Lawyer Trust Account rules or failure to comply with continuing legal education requirements, the Indiana Supreme Court announced Tuesday.

Among those facing suspension include 140 Indiana lawyers and 106 attorneys from out of state.

Data provided by the Indiana Supreme Court revealed that 140 attorneys failed to obtain their CLE credits, 133 did not pay their attorney registration fees and 27 attorneys failed to pay their fee and failed to obtain their CLE credits.

“Although the suspension is effective as of the date of this order for purposes of the reinstatement procedures that must be followed and/or any reinstatement fees that must be paid for reinstatement, the Court directs that the proscription against the actual practice of law will go into effect at 12:01 a.m. Eastern Daylight Savings Time on Tuesday, June 28, 2022,” Chief Justice Loretta Rush wrote in the June 7 order. “The delay from the date of this order to the suspension date is for the sole purpose of allowing time for copies of this order to be sent, received, and acted upon by the suspended attorneys.”

Attorneys named in the order may be reinstated by complying with the applicable reinstatement procedures and by paying any applicable penalties.

Requirements for reinstatement for dues violations are found in Indiana Disciplinary Admission and Discipline Rule 2(h). The reinstatement procedure for failure to comply with CLE requirements can be found in Indiana Admission and Discipline Rule 29, section 10(b). The rules are available here.

According to the order, certain attorneys may have asked IOACE for extensions of time to comply with the rules governing CLE requirements.

“If the Commission has decided that sufficient reasons exist to grant an extension, as provided in Admission and 2 Discipline Rule 29, section 8, then the attorney’s name will not appear on the list of suspended attorneys attached to this order,” Rush concluded in In the Matter of Failure to Comply with Continuing Legal Education Requirements, Nonpayment of Attorney Registration Fees, and/or Failure to Submit IOLTA Certification, 22S-MS-170.
